The mediator is a neutral party who helps the parties find common ground and facilitate resolution of the relevant issues on the table. Mediation is generally less expensive than traditional divorce litigation, as both parties split the cost of the one neutral facilitator rather than each party paying for legal counsel. Oftentimes, clients going through mediation will utilize the services of outside matrimonial counsel to guide them through the mediation process and to review any written agreements which result from mediation. Trust between the parties is critical for the success of mediation.
  • Collaborative law: Collaborative law is a process in which each party is represented by trained collaborative counsel. Both parties, with their respective attorneys, work together to find agreeable solutions to the various issues involved in the divorce. The lawyers can also bring in coaches, experts and other professionals to help with the process. The primary distinguishing characteristic of collaborative law among the various forms of ADR for divorce is that the parties and lawyers agree that should the collaborative process break down, collaborative counsel cannot represent the clients in Court. In most cases, collaborative law allows both parties to work in a harmonious way and it results in more creative, personally tailored parenting plans.
  • Other non-litigious family law ADR methods: There are many methods for resolving divorce-related disputes outside of traditional litigation. In some cases, it can be as simple as calling opposing counsel and working collaboratively to negotiate the terms of your matter.
